These Terms of Service ("Terms") govern your access to and use of Fed-Spend Intelligence ("Fed-Spend," "we," "us," or "our") services, including our website, API, and related services.
1. Acceptance of Terms
By accessing or using Fed-Spend, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.
2. Description of Services
Fed-Spend provides federal contract intelligence services, including:
- Federal contract search and discovery
- Recompete opportunity tracking
- Set-aside contract monitoring
- Email and webhook alerts
- API access for integrations
- Data export and analytics
3. Account Registration
To use Fed-Spend, you must create an account using Google or GitHub OAuth. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Subscription Plans & Billing
4.1 Free Tier
Free accounts have limited access to features and search capabilities as described on our pricing page.
4.2 Paid Subscriptions
- Subscriptions are billed monthly or annually in advance
- Payments are processed by Stripe and subject to their terms
- All fees are non-refundable except as required by law
- We may change pricing with 30 days notice
4.3 Cancellation
You may cancel your subscription at any time. Access continues until the end of your current billing period. No partial refunds are provided.
5. Acceptable Use
You agree NOT to:
- Use the service for any illegal purpose
- Attempt to reverse engineer or scrape our platform
- Share your account credentials with others
- Resell access to Fed-Spend without authorization
- Overwhelm our systems with automated requests beyond API limits
- Use the service to harass, defame, or harm others
- Interfere with the operation of our services
6. API Usage
If you use our API, you additionally agree to:
- Respect rate limits and usage quotas for your plan
- Secure your API keys and not share them publicly
- Include appropriate attribution when displaying our data
- Not use the API to build a competing service
7. Data Sources & Accuracy
Fed-Spend aggregates data from public government sources including USASpending.gov, SAM.gov, and FPDS. While we strive for accuracy:
- Data is provided "as is" without warranty of accuracy
- We are not responsible for errors in source data
- Users should verify critical information from official sources
- Data freshness depends on government publication schedules
8. Intellectual Property
Fed-Spend owns all rights to our platform, including software, design, and proprietary analysis tools. Government contract data itself is public domain. You may not copy, modify, or distribute our proprietary elements without permission.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Fed-Spend is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to fees paid in the prior 12 months
- We do not guarantee service availability or uptime
10. Indemnification
You agree to indemnify and hold harmless Fed-Spend and its officers, directors, and employees from any claims arising from your use of the service or violation of these Terms.
11. Termination
We may suspend or terminate your account for violations of these Terms. You may terminate your account at any time by contacting support. Upon termination, your right to use the service ends immediately.
12. Governing Law
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Denver, Colorado.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or prominent notice on our website at least 30 days before taking effect. Continued use after changes constitutes acceptance.
